Bir birey, herhangi bir bask\u0131 alt\u0131nda kalmadan kararlar alabiliyor ve kendi istekleri do\u011frultusunda hareket edebiliyorsa \u00f6zg\u00fcr say\u0131l\u0131r. \u00d6zg\u00fcrl\u00fc\u011f\u00fcn s\u0131n\u0131r\u0131, keyfi zorlamalara maruz kalmamakt\u0131r. \u0130nsan Haklar\u0131 Evrensel Bildirgesi&#8217;ne g\u00f6re t\u00fcm insanlar \u00f6zg\u00fcr do\u011far. \u00d6zg\u00fcr irade, bask\u0131 alt\u0131nda olmadan veya d\u0131\u015f bir g\u00fcce ba\u011fl\u0131 kalmadan karar verebilmektir.<\/p>\n\n\n\n<p>Filozoflara g\u00f6re, se\u00e7mek ve tercihte bulunmak \u00f6zg\u00fcr olmakt\u0131r. Atat\u00fcrk, siyasi otoritenin tutumu, \u00fclkenin durumu ve i\u015fgalcilerin g\u00fcc\u00fc gibi d\u0131\u015f etkenlere ra\u011fmen, se\u00e7imlerinin sonu\u00e7lar\u0131n\u0131 d\u00fc\u015f\u00fcnerek kendi kararlar\u0131n\u0131 alm\u0131\u015ft\u0131r. Eyleme ge\u00e7meme \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc kullanmak yerine, d\u0131\u015f etkilerden ba\u011f\u0131ms\u0131z olarak ald\u0131\u011f\u0131 kararlar do\u011frultusunda hareket etmi\u015ftir.<\/p>\n\n\n\n<p><strong>\u00d6zerk Birey \u00d6rnekleri<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Bir milletvekilinin, partinin karar\u0131n\u0131n kendi do\u011frular\u0131yla \u00e7eli\u015fmesi \u00fczerine bu karara uymay\u0131 reddederek kendi d\u00fc\u015f\u00fcncesine g\u00f6re hareket etmesi, \u00f6zerklik kavram\u0131yla ili\u015fkilidir.<\/li>\n\n\n\n<li>Ailesi taraf\u0131ndan ekonomik getirisi y\u00fcksek bir mesle\u011fe y\u00f6nlendirilen bir \u00f6\u011frencinin (Eren), sevdi\u011fi ve istedi\u011fi alanda e\u011fitim almay\u0131 se\u00e7mesi, \u00f6zerk bir bireyin davran\u0131\u015f \u00f6zelli\u011fidir.<\/li>\n\n\n\n<li>\u015eair Jean Jacques Rousseau&#8217;nun &#8220;\u0130nsan\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fc istedi\u011fi her \u015feyi yapabilmesinde de\u011fil, istemedi\u011fi hi\u00e7bir \u015feyi yapmak zorunda olmamas\u0131ndad\u0131r&#8221; s\u00f6z\u00fc, \u00f6zg\u00fcr ve \u00f6zerk birey a\u00e7\u0131s\u0131ndan yorumlanabilir.<\/li>\n<\/ul>\n\n\n\n<p><strong>Hak Arama Yollar\u0131<\/strong><\/p>\n\n\n\n<p>Demokrasiyi benimsemi\u015f toplumlarda haklar demokratik yollarla aran\u0131r ve sorunlar uzla\u015f\u0131yla \u00e7\u00f6z\u00fclmeye \u00e7al\u0131\u015f\u0131l\u0131r. Ancak bazen uzla\u015f\u0131 olmazsa, \u00e7\u00f6z\u00fcm hukukta aran\u0131r. Hukuk kurallar\u0131, anla\u015fmazl\u0131klar\u0131n \u00e7\u00f6z\u00fcm\u00fcnde belirleyicidir ve haks\u0131zl\u0131\u011fa u\u011frayanlar\u0131n haklar\u0131n\u0131 korur. Hak ararken kullan\u0131labilecek en etkili yollardan biri yarg\u0131 yoluna ba\u015fvurmakt\u0131r.<\/p>\n\n\n\n<p>Yarg\u0131 yolu d\u0131\u015f\u0131nda da hak aranabilecek kurum ve kurulu\u015flar vard\u0131r. Ba\u015fl\u0131calar\u0131 \u015funlard\u0131r:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>T\u00fcketici Hakem Heyeti.<\/li>\n\n\n\n<li>Kamu Denet\u00e7ili\u011fi Kurumu.<\/li>\n\n\n\n<li>\u0130l ve \u0130l\u00e7e \u0130nsan Haklar\u0131 Kurullar\u0131.<\/li>\n<\/ul>\n\n\n\n<p>T\u00fcketici Hakem Heyetleri, t\u00fcketici i\u015flemleri ve uygulamalar\u0131ndan do\u011fan anla\u015fmazl\u0131klar\u0131 \u00e7\u00f6zmeye \u00e7al\u0131\u015f\u0131r. \u00d6rne\u011fin, kusurlu \u00e7\u0131kan bir \u00fcr\u00fcn i\u00e7in sat\u0131c\u0131 \u00e7\u00f6z\u00fcm sunmazsa, T\u00fcketici Hakem Heyetine ba\u015fvurulabilir. Bu heyetler, 6502 say\u0131l\u0131 T\u00fcketicinin Korunmas\u0131 Hakk\u0131nda Kanun&#8217;a g\u00f6re kurulmu\u015ftur.<\/p>\n\n\n\n<p><strong>Kamu Kurumlar\u0131na ve Uluslararas\u0131 Makamlara Ba\u015fvuru<\/strong><\/p>\n\n\n\n<p>Kamu Denet\u00e7ili\u011fi Kurumu (Ombudsmanl\u0131k), kamu kurumlar\u0131n\u0131n ve \u00e7al\u0131\u015fanlar\u0131n\u0131n i\u015flem, eylem ve davran\u0131\u015flar\u0131na ili\u015fkin \u015fikayetleri inceler. Kurumun g\u00f6revi, gelen \u015fikayetleri insan haklar\u0131 ve hukuk a\u00e7\u0131s\u0131ndan inceleyip ara\u015ft\u0131rmak ve idareye tavsiyelerde bulunmakt\u0131r. Vatanda\u015flar, \u00e7ocuklar, engelliler, m\u00fclteciler, ge\u00e7ici ikamet edenler, turistler, dernek ve \u015firketler gibi, idare taraf\u0131ndan menfaati ihlal edilen herkes Kamu Denet\u00e7ili\u011fi Kurumu&#8217;na ba\u015fvurabilir. Kamu Denet\u00e7ili\u011fi Kurumu&#8217;na ba\u015fvurular \u00fccretsizdir ve talep edildi\u011finde veya gerek g\u00f6r\u00fcld\u00fc\u011f\u00fcnde gizli tutulabilir.<\/p>\n\n\n\n<p>Ba\u015fvuru yollar\u0131 \u015funlard\u0131r: e-ba\u015fvuru, Kaymakaml\u0131k ve Valilikler, \u015fahsen, e-Devlet \u00fczerinden, posta ile veya web sitesi arac\u0131l\u0131\u011f\u0131yla.<\/p>\n\n\n\n<p>\u0130l ve \u0130l\u00e7e \u0130nsan Haklar\u0131 Kurullar\u0131, insan haklar\u0131na ili\u015fkin ihbar, dilek, talep ve \u015fikayeti olan vatanda\u015flar\u0131n ba\u015fvurabilece\u011fi kurullard\u0131r. Vatanda\u015flar, ya\u015fad\u0131klar\u0131 hak ihlalini gidermek i\u00e7in bu kurullara bireysel ba\u015fvuru yapabilirler.<\/p>\n\n\n\n<p>\u00d6nemli bir hak arama yolu da dilek\u00e7e hakk\u0131d\u0131r. \u0130nsanlar, haklar\u0131 ihlal edildi\u011finde ilgili makamlara dilek\u00e7e ile ba\u015fvurarak haklar\u0131n\u0131 arayabilirler. Bu hak, hukuk devletlerinin belirleyici \u00f6zelliklerindendir ve T.C. Anayasas\u0131&#8217;n\u0131n 74. maddesinde d\u00fczenlenmi\u015ftir.<\/p>\n\n\n\n<p>Hak ihlalleriyle ilgili ba\u015fvurulabilecek uluslararas\u0131 kurumlar da vard\u0131r. Bu kurumlar\u0131n en \u00f6nemlilerinden biri Avrupa \u0130nsan Haklar\u0131 Mahkemesi (A\u0130HM)&#8217;dir. A\u0130HM&#8217;e ki\u015filer ve topluluklar ba\u015fvuru yapabilir, ancak bunun i\u00e7in \u00fclkenin kendi i\u00e7 hukukundaki t\u00fcm yasal yollar\u0131n t\u00fckenmesi ve ba\u015fvurunun kesin karardan sonra d\u00f6rt ay i\u00e7inde yap\u0131lmas\u0131 gerekir.<\/p>\n\n\n\n<p><strong>Sivil Toplum Kurulu\u015flar\u0131 ve Hak Arama Bilinci<\/strong><\/p>\n\n\n\n<p>Hak arama yollar\u0131 sadece bireysel giri\u015fimleri i\u00e7ermez. Toplumsal sorunlar\u0131 \u00e7\u00f6zmek i\u00e7in vatanda\u015flar\u0131n \u00f6rg\u00fctlenerek ortak bilin\u00e7le hareket etmesi gerekebilir. Bu ortak bilincin \u00fcr\u00fcn\u00fc olan Sivil Toplum Kurulu\u015flar\u0131 (STK), bireylere dayan\u0131\u015fma i\u00e7inde hak arama f\u0131rsat\u0131 sunar. STK&#8217;ler, haklar ve hak ihlalleri hakk\u0131nda bilgilendirme, bilin\u00e7lendirme ve kamuoyu olu\u015fturma gibi faaliyetlerle haklar\u0131n bilin\u00e7li kullan\u0131lmas\u0131n\u0131 sa\u011flar ve sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fcne katk\u0131da bulunur.<\/p>\n\n\n\n<p>Ailede, okulda ve \u00e7evrede hak ve \u00f6zg\u00fcrl\u00fcklerin korunmas\u0131, bu hak arama yollar\u0131n\u0131n bilincinde olan ve bunlar\u0131 kullanmaktan \u00e7ekinmeyen bireylerin varl\u0131\u011f\u0131yla m\u00fcmk\u00fcnd\u00fcr. Bireylerin hak arama konusunda bilin\u00e7lenmesi ve birbirlerini te\u015fvik etmesi, toplumsal g\u00fcven ve huzur i\u00e7in \u00f6nemlidir.<\/p>\n\n\n\n<p><strong>Demokratik Karar Alma S\u00fcre\u00e7lerine Kat\u0131l\u0131m<\/strong><\/p>\n\n\n\n<p>Demokrasinin geli\u015fmesi ve demokrasi k\u00fclt\u00fcr\u00fcn\u00fcn yerle\u015fmesi i\u00e7in aktif vatanda\u015flar ve kat\u0131l\u0131m \u00e7ok \u00f6nemlidir. Kat\u0131l\u0131m, bireylerin \u00e7e\u015fitli yollarla kamu kurumlar\u0131n\u0131n karar ve uygulamalar\u0131n\u0131 etkilemesine ve bir \u00f6l\u00e7\u00fcde sorumluluk almas\u0131na olanak sa\u011flayan bir olgudur. Bireyler, toplumda karar alma s\u00fcre\u00e7lerini etkileyebilirler. Bunun bir\u00e7ok yolu vard\u0131r. \u00d6rne\u011fin, bireyler kendi g\u00f6r\u00fc\u015flerini en iyi temsil eden partiye oy vererek veya se\u00e7imlerde aday olarak toplumun \u015fekillendirilmesinde rol \u00fcstlenebilirler.<\/p>\n\n\n\n<p>Karar alma s\u00fcre\u00e7lerine kat\u0131lman\u0131n oy vermek d\u0131\u015f\u0131nda ba\u015fka yollar\u0131 da \u015funlard\u0131r:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Yetkililerle ileti\u015fime ge\u00e7mek.<\/li>\n\n\n\n<li>G\u00f6r\u00fc\u015f bildirmek.<\/li>\n\n\n\n<li>Protesto etmek.<\/li>\n\n\n\n<li>Dilek\u00e7e vermek.<\/li>\n\n\n\n<li>Bar\u0131\u015f\u00e7\u0131l g\u00f6steriler yapmak.<\/li>\n\n\n\n<li>\u0130mza toplamak.<\/li>\n\n\n\n<li>STK&#8217;lere \u00fcye olmak.<\/li>\n<\/ul>\n\n\n\n<p>Kat\u0131l\u0131m, tam olarak ayr\u0131lmasa da bireysel ve toplumsal olarak iki \u015fekilde ger\u00e7ekle\u015fir. Bireysel kat\u0131l\u0131m bi\u00e7imleri \u015funlard\u0131r: oy vermek, devlete dilek\u00e7e vermek, sosyal medyada g\u00f6r\u00fc\u015f belirtmek, toplant\u0131 ve g\u00f6sterilere kat\u0131lmak. Toplumsal kat\u0131l\u0131m ise, ba\u015fta STK&#8217;ler olmak \u00fczere bir ama\u00e7 i\u00e7in bir araya gelen insanlar\u0131n eylemleridir.<\/p>\n\n\n\n<p><strong>Sorunlar\u0131n \u00c7\u00f6z\u00fcm\u00fcnde Aktif G\u00f6rev Almak<\/strong><\/p>\n\n\n\n<p>Demokrasinin geli\u015fti\u011fi toplumlarda, sorunlara duyarl\u0131, hak ve \u00f6zg\u00fcrl\u00fcklerini kullanma ve koruma bilincine sahip aktif vatanda\u015flar bulunur. Aktif vatanda\u015fl\u0131k, kar\u015f\u0131l\u0131kl\u0131 sayg\u0131 i\u00e7inde, \u015fiddete ba\u015fvurmadan, insan haklar\u0131na ve demokrasiye uygun bir \u015fekilde sivil topluma ve\/veya siyasi ya\u015fama kat\u0131l\u0131md\u0131r.
